A California judge has ruled that plaintiffs involved lawsuits regarding the DePuy ASR metal-on-metal hip implant may now file claims over the Pinnacle acetabular cup device. The cases in question involve seven lawsuits filed over the DePuy ASR metal-on-metal devices in the wake of the devices recall. According to MassDevice.com, the plaintiffs involved in these seven cases were advised that they were permitted to file claims over the Pinnacle device.

Johnson & Johnson (J&J) biomedical arm DePuy had requested a new trial following the March trial in Los Angeles. In the original case, the jury found that the DePuy ASR hip implants were designed with defects and caused injuries to Kransky, a former Montana prison guard. DePuy announced in April that it would attempt to overturn the decision. DePuy had requested for a stay on the judgment and for the ability to file an appeal without bond. Judge J. Stephen Czuleger denied the request for a new trial and upheld the decision of the jury. Law360.com reports that the appeal was denied on the grounds that Kransky had provided sufficient evidence that the product were, in fact, defective.

The second major DePuy ASR Recall Case has been officially postponed until September 2013. Judge David A. Katz has filed an updated order that pushes the case from July to September in the U.S. district court for the Northern District of Ohio. The first bellwether trial was postponed only three days before the July trial. The initial trial was moved from May 6 to June 3, 2013.
